Deacons' IP Partner Charmaine Koo was interviewed by and quoted on Monday 24 July in an article "Litigation hope for businesses in China" in Managing Intellectual Property's Weekly News about the recent agreement signed between Hong Kong and China on reciprocal enforcement of court judgments. Charmaine was quoted as saying the agreement is "a step in the right direction but in terms of IP it is not the complete solution" since the arrangement does not include enforcement of injunctions which is particularly important in IP cases. Further, since the arrangement only applies to situations where there are existing contractual agreements between the parties, it may be applicable to agreements with OEM manufacturers but would not be useful as a tool against an infringer who does not have an existing relationship with a IP rights holder. IP Owners should give careful thoughts about the choice of jurisdiction clause in their agreements.
